Terms of Service

Welcome to Rackerman. These Terms of Service ("Terms") govern your use of www.rackerman.co.uk (the "Site") and any orders you place with us. By accessing, browsing, or using the Site, or by placing an order, you agree to these Terms. Please read them carefully. We may update these Terms at any time, and the version in force at the time of your order will apply.

Using our site

By using this Site you confirm that you are at least 18 years old, or are using it under the supervision of a parent or guardian. You agree to use the Site only for lawful purposes and not to misuse it in any way, including by introducing viruses or other malicious code, attempting to gain unauthorised access, or using it to harm others or infringe anyone's rights.

We reserve the right to refuse service, restrict access, cancel orders, or remove content at our discretion, including where we reasonably believe a customer's conduct breaches these Terms, is unlawful, or is harmful to our business or other customers.

Products and pricing

We make every effort to display our products, specifications, and prices accurately. However:

  • Product images and descriptions are for guidance. Steel and metal products are industrial goods and may vary slightly in appearance, finish, and tolerance in line with normal manufacturing standards.
  • Prices are shown inclusive and exclusive of VAT where indicated, and are correct at the time of display. We reserve the right to change prices at any time before an order is accepted.
  • If we discover an error in the price or description of a product after you have ordered, we will contact you to confirm whether you wish to proceed at the correct price or cancel the order.
  • All orders are subject to availability and our acceptance.

Orders and payment

When you place an order, you are making an offer to purchase. A contract is formed only once we accept and confirm your order. Payment must be received in full before goods are dispatched, unless otherwise agreed in writing. We accept the payment methods displayed at checkout.

Cut-to-size and made-to-order items

Some of our products, including steel sections cut to your specified lengths, are supplied as a made-to-order cutting service. Because these items are cut to your specification, they are non-returnable and non-refundable under the Consumer Contracts Regulations, except where the goods are faulty or not as described. Please check your measurements carefully before ordering. Where cutting is requested, you will receive any offcuts, as the full length is yours.

Delivery

Delivery times and arrangements are set out on our Delivery page. Lead times are estimates and not guaranteed. For large or heavy items, offloading assistance may be required at the delivery point, as detailed at the time of order. Risk in the goods passes to you on delivery.

Returns and cancellations

Your rights to return or cancel an order are set out in our Refund Policy, which forms part of these Terms. Please note the exclusions that apply to cut-to-size and made-to-order items, as described above.

Intellectual property

All content on this Site, including text, images, logos, designs, and graphics, is owned by or licensed to Rackerman Limited and is protected by law. You may view and use the Site for your own personal, non-commercial shopping purposes. You may not reproduce, copy, distribute, sell, or commercially exploit any part of the Site without our prior written permission.

Liability

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot lawfully be excluded. Subject to that, we are not liable for any indirect or consequential loss, and our total liability for any order will not exceed the value of that order. It is your responsibility to ensure that any product you purchase is suitable and fit for your intended purpose; where structural or load-bearing applications are involved, you should obtain appropriate professional or engineering advice.

Governing law

These Terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales. Nothing in these Terms affects your statutory rights as a consumer.
